Bad Checks

WRITING A COLD CHECK IS AGAINIST THE LAW!

Our new program puts the burden back on cold check writers and rewards businesses every day. 

HOW IT WORKS!

A merchant receives a cold check from a customer and presents it to our office.  Our office creates a complaint and a letter is mailed to the cold check writer together with a preprinted deposit slip instructing the check writer to make payment on the cold check at Fifth Third Bank within ten business days from the date of the letter. 

The check writer then takes cash, certified check or a money order to the bank and pays the face amount of the check, in addition to the County Attorney's Fee and the Merchant's Fee.

Checks are distributed to Merchants twice monthly and a detailed report is attached for verification.

If the check writer fails to make good on the check within the 10 day period, the system notifies us that payment has not been made and prosecution begins immediately thereafter.  The Merchant will be notified to come into our office to sign a criminal summons or warrant, depending on several factors.   If the amount of the check exceeds $300, that crime is a Class D Felony.  Otherwise, it is a Class A misdemeanor.

The Summons or Warrant is signed by the Judge and then submitted to the Sheriff's Office.  The check writer now becomes the defendant.  If a warrant is issued, the defendant will be arrested and given a court date.  If the defendant is being summoned to court, a court date will be assigned.  In both cases, additional expenses of court costs and service fees will be incurred.

What law allows the prosecution of people who write bad checks? 

The Bad Check Program operates under the Theft by Deception Statute, KRS 514.040.

 

What steps can I take to avoid becoming a victim of a cold check?

  • Check a picture ID
  • Write the Driver's License Number on the check
  • Confirm the information on the check matches the information on the  picture ID
  • Write the person's date of birth on the check
